Terms of Service

1. Acceptance of Terms

By creating an account, subscribing to any plan, or using the MyAvatar platform ("Service"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

You must be at least 18 years of age to use MyAvatar. By using the Service, you confirm that you are 18 or older. MyAvatar does not knowingly provide services to minors.

2. Description of Service

MyAvatar is an AI-powered video production platform that enables users to create, edit, and distribute AI-generated video content. The Service uses third-party AI models and services including but not limited to Kling, Seedance, WAN, HeyGen, ElevenLabs, and Google Veo.

Content generated through the Service is AI-generated. Users acknowledge this when publishing or distributing content created on the platform.

3. User Accounts and Subscriptions

3.1 You are responsible for maintaining the confidentiality of your account credentials.

3.2 Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by applicable law.

3.3 We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree not to use the Service to create, distribute, or facilitate content that:

• Is illegal under applicable law in your jurisdiction or ours
• Depicts, promotes, or facilitates sexual exploitation, abuse, or content involving minors (CSAM) — zero tolerance, immediate termination and reporting to authorities
• Constitutes defamation, harassment, or targeted abuse of individuals
• Impersonates real persons without their consent in a misleading or harmful manner
• Constitutes hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Promotes or facilitates terrorism, violent extremism, or mass harm
• Violates third-party intellectual property rights
• Is designed to deceive (deepfakes used for fraud or non-consensual intimate imagery)
• Violates any applicable export control or sanctions regulations

5. AI-Generated Content — Transparency

In accordance with the EU AI Act and applicable regulations, you acknowledge that:

• Content produced using MyAvatar is AI-generated
• You are responsible for disclosing the AI-generated nature of content where required by law or platform policies
• MyAvatar provides AI transparency labelling features which you are encouraged to use

6. Intellectual Property

6.1 Your content: You retain ownership of content you upload to the platform (scripts, images, brand assets).

6.2 Generated content: Subject to third-party AI model terms, you own the AI-generated output created through your account for commercial purposes. You grant MyAvatar a limited licence to store and process your content solely to provide the Service.

6.3 Our platform: MyAvatar retains all rights to the platform, software, and proprietary technology.

7. Third-Party AI Models

The Service relies on third-party AI providers. These providers have their own content policies which apply in addition to ours. MyAvatar is not liable for content rejected, modified, or filtered by third-party AI providers. Third-party providers may change their policies without notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MyAvatar ApS shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you shall not exceed the fees paid by you in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless MyAvatar ApS, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of Denmark. Disputes shall be submitted to the courts of Copenhagen, Denmark, unless mandatory consumer protection law in your jurisdiction requires otherwise.

11. Changes to Terms

We may update these Terms at any time. We will notify you by email or prominent notice on the platform. Continued use after the effective date constitutes acceptance of the updated Terms.
